Former MSP Detective Brian Keely will go to trial in the death of Samuel Sterling from back in April.
Judge Amanda Sterkenburg delivered a calm, steady, rending of her decision to an online audience.
"Defendant could have slowed or braked much earlier than he chose too, could have ceased his pursuit in the vehicle and proceeded on foot. Or simply veered in the other direction upon gaining proximity to the defendant, to the decedent. In failing to do so, there was impact between a human and a vehicle."
Sterkenburg went on to say that any normal individual would have seen that such a collision would "prove to be disastrous."
Now former MSP Detective Brian Keely will stand trial on second degree murder charges in the death of Samuel Sterling.
Keely sat facing the camera but did not say anything during the hearing.
It comes at a time when Keely's lawyers are arguing that the case should be heard in federal court since they argue Keely was acting as a federal agent at the time.
The judge in that hearing has not issued a ruling as of this point.
